Welcome to RIVES! These Terms of Service ("Terms") govern your use of the RIVES decentralized application, accessible at app.rives.io (the "dApp"), provided by the RIVES team (collectively referred to as "we," "our," or "us"). By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. Overview​

RIVES is an open-source, community-driven platform that facilitates the creation and interaction with on-chain games, cartridges, and related content. The Platform operates under an evolving governance and legal structure, and updates will be reflected in these Terms. The open-source code base for RIVES is publicly available at GitHub Repository. Contributions are governed by applicable open-source licenses.

2. Acceptance of Terms​

By accessing or using the Platform, you represent and warrant that:

  • You are at least 18 years old or the age of majority in your jurisdiction.
  • You agree to comply with all applicable laws, rules, and regulations in your location.
  • You acknowledge that RIVES is experimental and operates on blockchain infrastructure, which carries risks, including loss of digital assets.

3. Open Source and Decentralized Nature​

  • RIVES operates as an open-source project, encouraging community contributions under the applicable open-source license.
  • The RIVES team does not centrally control all aspects of the Platform. Certain functionalities may depend on third-party decentralized protocols or community contributions.

4. Disclaimer of Liability​

  • No Guarantees: The Platform is provided "as is" without warranties of any kind, whether express or implied, including, but not limited to, merchantability, fitness for a particular purpose, or non-infringement.
  • Blockchain Risks: Transactions conducted through the Platform may involve digital assets on blockchain networks. We are not responsible for any losses, including those due to smart contract errors, bugs, or network instability.
  • Third-Party Content: The Platform may interact with third-party tools, content, or protocols. We are not responsible for third-party actions or failures.

5. User Responsibilities​

  • Compliance: You are solely responsible for ensuring your use of the Platform complies with applicable laws in your jurisdiction.
  • Security: You are responsible for the security of your digital wallets and private keys. Never share sensitive credentials.

6. Intellectual Property​

  • RIVES is open-source, and contributions are governed by the applicable open-source licenses.
  • Users retain ownership of their original content but grant the RIVES community a perpetual, non-exclusive license to use, modify, and share contributions within the Platform ecosystem.

7. Modifications to the Terms​

We may update these Terms as the Platform evolves. Updates will be posted on the Platform, and your continued use constitutes acceptance of the revised Terms.

8. Fees​

Transactions on the Platform may incur network fees (e.g., gas fees). These fees are determined by the blockchain network and are not controlled by RIVES.

9. Limitation of Liability​

To the fullest extent permitted under applicable laws, RIVES and its contributors will not be liable for:

  • Indirect, incidental, or consequential damages;
  • Loss of digital assets, profits, or data;
  • Actions of third parties, including other users or developers.

10. Dispute Resolution​

Any disputes arising from or related to these Terms shall be resolved in accordance with general principles of neutrality and fairness. The Platform does not tie itself to any specific jurisdiction but encourages parties to resolve disputes amicably or through mutually agreed arbitration mechanisms.

11. Future Governance​

As RIVES evolves, governance structures may change, including the potential formation of a DAO, foundation, or other legal entity. These Terms will be updated to reflect new governance frameworks.

12. Contests and Prizes​

From time to time, the Platform may host contests or competitions to encourage participation and creativity within the RIVES community. By participating in these contests, you agree to the following terms:

  • No Guarantee: Prizes are not guaranteed and are distributed at our sole discretion.
  • Eligibility: Participation in contests is subject to eligibility criteria specified in the contest rules.
  • No Liability: We are not responsible for any disputes, losses, or issues arising from your participation in contests or receipt of prizes.
  • Modification or Cancellation: We reserve the right to modify or cancel contests at any time without notice.
  • Compliance with Sanctions Laws: You represent and warrant that you are not a resident, national, or agent of, and do not represent any person or entity located in a country or region subject to sanctions laws, including but not limited to Cuba, Iran, North Korea, Syria, Belarus, Russia, or any other jurisdiction where participation is restricted by applicable sanctions laws. Additionally, you confirm that you are not listed on any government-issued sanctions or restricted parties list.
